Before and during the 1960s, there were very few regulations regarding asbestos. The first move to ban any asbestos products came with the Clean Air Act of 1970, which banned the usage of spray products that contained asbestos. However, these products did not make up the bulk of asbestos products and the majority of products made from the mineral were left unrestricted. The Toxic Substance Control Act of 1976, that allowed the EPA to place restrictions on the asbestos and asbestos materials, was the true beginning of tighter regulation on the usage of asbestos.

​Throughout the 1980s, additional restrictions were added.  The Asbestos Hazard Emergency Response Act of 1986 (AHERA) called for inspections and the removal of asbestos from within schools. It led to a ban on a total of seven types of asbestos products, including spray applied asbestos, flooring felt, commercial paper, corrugated paper, specialty paper, and any new usages of asbestos. The EPA pushed through the Asbestos Ban and Phase-Out Rule, which would've completely banned asbestos in the country. The phase-out ultimately failed when asbestos manufacturers were able to get the ban overturned in 1991.

Another attempt at a full asbestos ban resulted in the Ban Asbestos in America Act of 2002 but, like the previous attempt, it wasn't effective and the act never even got passed. The Bruce Vento Ban Asbestos and Prevent Mesothelioma Act, which would added increased restriction on the importation and usage of asbestos, reached congress in 2008 but didn't get very far through the process and once again, an asbestos ban act did not get passed. Since then, there have been no other attempts to push a complete ban on asbestos through congress.

 Currently legislation regarding asbestos and mesothelioma is focused on the procedures and information disclosure of mesothelioma compensation settlements rather than the regulation of asbestos. Although compensation settlements have always been considered private and handled as such, the Furthering Asbestos Claim Transparency Act, or FACT act, is aiming to make the details of those settlements public. It was introduced into congress in 2015 but has not been passed into law yet.
